Terms of Service

These terms (“Terms”) govern your access to and use of the Sardine Weather website, mobile application, and API (together, the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service Is

Sardine Weather is a data analytics tool. We publish statistical estimates of future daily high and low temperatures for specified U.S. cities, along with derived probability and fair-value numbers for individual Kalshi weather contracts. We do not place trades, hold positions on your behalf, custody funds, or provide personalized financial advice.

2. Not Financial Advice, Not a Solicitation

Nothing on the Service is investment, trading, tax, or legal advice. Fair value figures, edge figures, signal labels, and confidence tiers are mathematical outputs — not recommendations. Any decision to open, close, size, or avoid a position on Kalshi or any other venue is solely yours.

3. No Warranties

The Service is provided “as is” and “as available” without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that temperature predictions, fair values, or signals will be accurate. Historical model performance is not a guarantee of future accuracy.

4. Weather Data and Third-Party Services

The Service ingests weather observations and forecasts from the U.S. National Oceanic and Atmospheric Administration (NOAA) and the National Weather Service (NWS). That data is in the public domain. Market data is displayed with reference to Kalshi; Kalshi is an independent third party and is not affiliated with Sardine Weather. Links opened from the Service to Kalshi are governed by Kalshi's own terms, which you agree to separately when using their platform.

5. Eligibility

You must be at least 18 years of age to use the Service. Some functionality references contracts on prediction markets that may be restricted in your jurisdiction. You are responsible for determining whether access to or use of any linked third-party service is lawful where you live.

6. Your Use of the Service

You agree not to:

  • Resell, redistribute, scrape at scale, or rebroadcast the Service's predictions, fair values, or signal data as if they were your own.
  • Circumvent, disable, or interfere with any rate limit, security feature, or access control.
  • Use the Service in connection with any activity that violates applicable law, including anti-money-laundering, sanctions, or prediction-market regulations in your jurisdiction.
  • Represent the Service's output as financial advice, guaranteed outcomes, or as your own proprietary analysis.

7. Intellectual Property

Sardine Weather's proprietary code, model, design system, and brand are owned by us. Public-domain weather data is not owned by anyone and is reused accordingly. Our model outputs (predictions, fair values, signals) are licensed to you for personal, non-commercial use while these Terms are in effect.

8. Changes to the Service and to These Terms

We may modify the Service, the features available to free or paid users, and these Terms at any time. Material changes will be announced via the app or on this page. Continued use after changes take effect constitutes acceptance.

9. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms or attempts to abuse the API.

10. Disclaimer and Limitation of Liability

To the fullest extent permitted by law, Sardine Weather and its operators are not liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits or trading losses, arising out of your use of or inability to use the Service, whether based on contract, tort, or otherwise, even if we have been advised of the possibility of such damages. Our total liability to you for any claim relating to the Service will not exceed US$100 or the amounts you have paid us in the twelve months preceding the claim, whichever is greater.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
